Thinline Sintered Stone Warranty

Thinline 15-Year Limited Warranty

Thinline Sintered Stone hereby warrants to the owner of the installed Thinline Sintered Stone products that such products shall be free from manufacturing defects for a period of fifteen (15) years subject to the terms, conditions, limitations, and exclusions set forth herein.

This Warranty instrument shall apply to Sintered Stone surfaces that are duly registered under THINLINE SINTERED STONE, as well as to large-format Porcelain Slabs registered under said name, which are designed and intended for use in applications including, but not limited to, worktops, cladding, wall coverings, flooring, and other similar uses (hereinafter, the “Surfaces”).

In general, this Warranty shall include all products that do not constitute End Products manufactured by TSS, as defined in the corresponding provisions of this Warranty document.

Letter of Warranty

This Letter of Warranty (hereinafter, the “Warranty”) shall be deemed valid and enforceable solely upon satisfaction of the following conditions:

  1. The end user must present the original invoice or purchase receipt evidencing the date of purchase and the identity of the authorized dealer from whom the product was obtained.
  2. The end user must make the allegedly defective product available for inspection by Thinline Sintered Stone (hereinafter, “TSS”).

This Warranty shall be non-transferable

TSS reserves the right, in its sole discretion, to decline to provide warranty services without cost in the event any of the foregoing requirements are not fulfilled, or if any information provided by the end user in connection with this Warranty is determined to be false, incomplete, or illegible.

This Warranty is intended exclusively for non-professional end users and shall apply solely to residential uses, including but not limited to any building or facility utilized for private accommodation, whether a single-family or multi-family dwelling.

For the avoidance of doubt, any recommendation or referral by TSS to any independent contractor, including but not limited to installers or fabricators of TSS products (collectively, the “Independent Contractors”), shall not constitute or be construed as any representation, guarantee, warranty, or undertaking by TSS with respect to the fabrication, installation, workmanship, or performance of such Independent Contractors.

Any reference by TSS to designations such as “Certified Fabricator,” “Certified Installer,” or similar terms shall be understood solely as a non-binding recommendation or suggestion to the customer regarding Independent Contractors who may have undergone certain training provided by TSS or who may possess experience and knowledge regarding the installation or fabrication of TSS products.

Such references or recommendations shall not be interpreted as any promotion, assumption of liability, sponsorship, endorsement, guarantee, or warranty by TSS as to any acts, omissions, services, or obligations of such Independent Contractors.

TSS expressly disclaims any and all liability or responsibility whatsoever for the installation, fabrication, handling, or use of its products by any third party. Under no circumstances shall TSS be liable for any special, incidental, indirect, or consequential damages arising out of or related to the installation, fabrication, or use of its products.

I. Scope of Coverage

TSS hereby warrants and undertakes to repair or replace, at its sole discretion, any defective Surfaces in accordance with the terms and conditions set forth herein, ensuring the replacement product possesses the same essential characteristics (including, without limitation, color, thickness, and appearance) as the original product acquired by the purchaser.

This Warranty exclusively applies to products employed in accordance with their intended purpose and within the defined scope of use, provided they have been maintained in strict conformity with the care and maintenance guidelines. It is incumbent upon the purchaser to confirm and accept the selection of color and finish prior to consummating the purchase transaction, as any alterations, modifications, or substitutions made thereafter shall be expressly excluded from the coverage afforded under this Warranty.

This Warranty further extends to latent surface defects that were not reasonably detectable in quality inspections, including but not limited to material pathologies arising from the manufacturing process.

II. Exclusions and Limitations

The Warranty shall be rendered void and shall not apply under any of the following circumstances:

  1. Improper Installation: Any failure, defect, or damage arising from faulty or improper installation, fabrication, or assembly, including failure to adhere to TSS’s applicable recommendations, specifications, or technical documentation.
  2. Third-Party Intervention: Any defect, damage, or loss caused, whether directly or indirectly, by work, alteration, modification, or intervention performed by third parties unaffiliated with TSS, including but not limited to improper finishing, fabrication, or installation of the Surfaces, or the application of inappropriate treatment, misuse, impact, thermal shock, chemical exposure, or any manipulation resulting in alteration of the original product. All third parties are obligated to consult and comply with any manuals or guidelines issued by TSS in respect of fabrication, handling, installation, or related practices.
  3. Wear Marks: This Warranty expressly excludes coverage for any wear marks or surface blemishes affecting TSS products, including, without limitation, metal marks, fingerprints, smudges, or any other similar indications of wear or deterioration arising from the use of utensils or related implements.
  4. Force Majeure and Site Conditions: Any damage, defect, or deficiency resulting from force majeure events, site-specific conditions, architectural or engineering design flaws, structural movement, vandalism, accident, natural disaster, or any other cause beyond the reasonable control of TSS.
  5. Improper Use: Any damage arising from use inconsistent with the intended purpose of the product, including but not limited to: (i) utilization for purposes other than those specified by TSS; (ii) use in a manner not compliant with applicable technical or safety standards; or (iii) failure to adhere to the installation instructions.
  6. Non-Payment: Any products for which full payment has not been received by TSS.
  7. Third-Party Manufactured Products: Three-dimensional products manufactured or fabricated by third parties shall be excluded from coverage.
  8. Subjective Dissatisfaction: Any claims predicated upon the purchaser’s subjective dissatisfaction as to color, veining, patterning, edge profiles, or other aesthetic characteristics of the Surfaces that were selected and approved at the time of purchase.
  9. Sample Variations: Any differences or discrepancies between samples, photographs, or representations of TSS products and the actual product delivered.
  10. Unauthorized Repairs: This Warranty shall be null and void if any repair, modification, or handling is performed without prior opportunity for inspection and verification by TSS.
  11. Indirect and Consequential Loss: TSS shall not be liable for any incidental, indirect, consequential, or special damages, losses, or costs, including but not limited to damage to other property, facilities, or systems, or any ancillary expenses incurred in connection with plumbing, electrical, or construction work that may be necessary to repair or replace the Surfaces. All such costs shall be borne exclusively by the purchaser.
  12. Project Design Deficiencies: Any damage arising from errors, omissions, or deficiencies in the technical project underlying the construction in which the Surfaces are incorporated.
  13. Fabrication Disclaimer: TSS does not manufacture, fabricate, or install worktops or other finished applications; rather, it supplies material for such fabrication. Accordingly, where a claim is accepted under this Warranty, TSS shall only supply the replacement material, and all costs associated with fabrication, preparation, and installation shall be the sole responsibility of the purchaser.
  14. Discontinued Products: In the event the replacement of a defective product with identical characteristics is impossible due to product discontinuation, TSS reserves the right to substitute a comparable product of similar attributes then available.
  15. Surface Damage from External Agents: Any surface deterioration or damage resulting from exposure to external agents affecting appearance or finish.
